Temair, Inc. sponsors the web site carmun (the "Site"). This document describes Temair's policies concerning the use of personal information of Members collected via the Site ("Privacy Policy") as update on February 12, 2007. We reserve the right, in our discretion, to change, modify and delete provisions of this Privacy Policy at any time. If we do change how we use personally identifiable information (or make other changes to this Policy), we will post the changes on this page. We will also indicate the effective date, so that you are always aware of what information we collect, how we use it, and under what circumstances we may disclose it. Your continued use of the Site after such notice constitutes your acceptance of the modified Privacy Policy.

Temair is not responsible for any incorrect or inaccurate Content – including Personal Content – posted on the Site regardless of the cause or source, or for the conduct, online or offline, of any Member or other user of the Site. Without limiting the above, Temair assumes no responsibility for:

• any error, omission, interruption, deletion, defect, delay, communications failure, theft or destruction or unauthorized access to, or alteration of, user or Member postings or communications;
• the accuracy, integrity, completeness, or quality of any information, outputs or Content available from or through the Site; rather, responsibility for verification resides with the user of the information, output or Content.
• problems with telephone lines, computer systems, third party providers, or any technical problems or traffic congestion on the Internet or any website;
• injury or damage to users’, Members’ or other persons' computers or networks resulting from participating or downloading materials in connection with the Site;
• policies of any school, course or program that may prohibit use of the Site; therefore, before using the Site or any of its features or Contents, be sure that the use you intend to make is permitted by your school, course or program.

Under no circumstances will Temair be responsible for any loss or damage incurred or resulting from anyone's use, including your use, of the Site, any Content posted on the Site or communicated to members, or any interactions between users of the Site, online or offline. THE SITE AND CONTENT ARE PROVIDED "AS-IS" AND TEMAIR DISCLAIMS ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. Some states limit or prohibit the disclaimers of warranties in certain cases, so this disclaimer may not apply to you.

IN NO EVENT WILL TEMAIR BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS AND LOST DATA), OR FOR ANY DAMAGES IN EXCESS OF THE GREATER OR (I) $5000 OR (II) THE MEMBERSHIP FEES PAID BY YOU TO TEMAIR, ARISING FROM YOUR USE OF THE SITE, REGARDLESS OF THE CAUSE (INCLUDING NEGLIGENCE) AND EVEN IF TEMAIR WAS AWARE THAT SUCH DAMAGES MIGHT OCCUR. Some states limit or prohibit the limitation of liability in certain cases, so this limitation may not apply to you

If there is any dispute about or involving the Site, you agree that the dispute will be governed by the laws of the Commonwealth of Massachusetts, as they apply to residents situated within the state. You also agree to the exclusive jurisdiction and venue of the courts of the state and federal courts of Boston, Massachusetts, and waive all defenses of lack of personal jurisdiction or that the forum is not convenient, except that Temair may bring suit against you in any court that has jurisdiction over your person or property. Any cause of action by you with respect to the Site must be instituted within one (1) year after the cause of action arose or be forever waived and barred.

You agree to indemnify and hold Temair and its subsidiaries, affiliates, officers, agents, partners and employees harmless from any damage, liability, claim, or expense (including reasonable attorneys’ fees) arising out of or in connection with your use of the Site, your violation of these Terms of Use, your Personal Content, or your violation of the rights of a third party or any law.

These Terms of Use, and the accompanying Privacy Policy, constitute the entire agreement between you and Temair regarding the use of the Site and supersede any prior agreements between us on the same subject. Temair’s failure to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is held invalid, the remaining terms shall continue in full force and effect.

Without registering as a Member, you may use this Site to search for source information including citations, reviews, ratings and collections submitted by Members ("Source Data"). However, in order to have access to many Site features and services, you must register as a Member. This only requires that you provide a user name, email address and password and acknowledge that you agree to be bound by the Site Terms of Use and Privacy Policy. Once provided, Temair retains the right to use your email address for communication and other purposes, while you remain as a member, as described more completely below. As a Member you will also have the option of including other information in a Member Profile. Member Profiles can be found by other Members via a Member search and other means.

While you remain a Member, you can use the "My Profile" page to edit or delete information from your Member Profile. At any time, you can request to remove your Member Profile from the Site by sending an email to help at carmun.com; however, doing so will erase an personal work that you have stored on carmun. Also, any Source Data that you made available for Member viewing will remain available for such viewing by Members, and associated with your user name, even after you cease to be a Member.

Temair is the sole owner of the data and information collected on this Site, except for Personal Content (see the Terms of Use). We may track your activities and use the information you contribute for administration of the Site; to contact you about new services, features and changes on our Site; for the purpose of internal review and analysis; and for external sanitized (i.e. not personally identifiable) studies and reports. We can use your personal information as authorized until you cease to be a Member or you notify us that you are withdrawing this authorization (and for 30 days after, to provide us sufficient time to remove your information from our databases, mailing lists and the like).

Notwithstanding the above, once you provide an email address, we retain that, and the right to use it to contact you, related to the site, except as may be provided by law.

The personal information you provide us may be given to law enforcement officials if we believe we must do so to comply with an applicable statute, regulation, rule or law, a subpoena, a search warrant, a court order, or other valid legal process. We may also disclose personally identifiable information when we conclude that disclosing it is necessary to identify, contact or bring legal action against someone who may be violating our Terms of Use or to protect the safety or security of our Members, our company or the general public.

We use cookies and log files to administer the Site. A log file is a list of recent actions that is maintained by our servers. A cookie is a piece of data that we store on your hard drive and that may contain information about you and your computer. This promotes ease of communication between your computer and the Site and enables us to target relevant announcements and promotional material to Members. (You may be able to use your computer's control panel to disable cookies; but doing so may affect your ease in using the Site.)

We have no access to or control over any cookies that may be used by linked or other third party sites.

Understandably, our affiliates, partners and advertisers may want to know about the demographics and characteristics of our Members. Therefore, we may share aggregated demographic information data with them. This is group data that breaks down information about the broad characteristics of our users and is not linked to any personal information that can identify individual persons.

However, if Temair or carmun is sold to a new owner, whether by merger, stock sale, asset sale or other means, we retain the right to transfer your Member Profile, Source Data and all other Personal Content, data and information to this new owner, provided the owner agrees to respect the Privacy Policy in effect with respect to this personal data.

This Site may contain links to other sites. Please be aware that Temair cannot be responsible for the privacy practices of other sites, including those to which we link or whose products or services we reference. We encourage you to read the terms of use and privacy statements of each Web site you visit. This Privacy Policy applies solely to information collected by this Site.

This Site has reasonable security measures in place to protect against misuse or unauthorized disclosure of your personal information, but it does not take special precautions, such as secure socket layers, to protect information from unauthorized tampering.

Members will sometimes receive advertising, promotions and information about our own or third parties'products and services. We may also send you Site updates and information about new features of the Site. We may communicate with you via email to provide requested services, and in regard to issues relating to your account.

If you wish to correct, update or remove any personal data in your Member Profile, you may do so at any time by using the My Profile page. If you have already registered but want to be removed completely from our database, please email help at carmun.com. However, as noted above, any Source Data that you chose to make available for viewing by other Members will remain available for such viewing, and associated with your user name, even after you cease to be a Member.

Welcome to carmun, an online information exchange and rating service for academic research and content sponsored by Temair, Inc. (the “Site"). This Site is intended for use mainly by those interested in academic research including high school, college and graduate students and faculty. By using the Site you signify that you have read, understand and agree to be bound by these Terms of Use and the accompanying Privacy Policy.

You agree that Temair may refuse your registration or terminate your access and account for violating any Rules of Conduct or other Terms of Use, for any behavior that is inconsistent with Temair’s image or values, or for any other reason, entirely in its discretion.

You acknowledge that Temair and its licensors own all rights, title and interest in all content on the Site (except “Source Data? and other “Personal Content,? as defined below), including but not limited to the Site’s design, text, graphics and files, and their selection and arrangement (the "Content"), and you agree not to modify, copy, distribute, frame, republish, display, post, transmit, or sell the Content, except as may be expressly permitted by Temair. You may download and print reasonable portions of the Content, including any Source Data or other Personal Content of other Members, solely for your personal, non-commercial use, provided that you leave intact all copyright notices and identifying information appearing on the original. You are solely responsible for the source information, including citations, reviews, ratings, and collections that you create (“Source Data?), including those you elect to make available for viewing by other Members, as well as all images and other content that you publish or display on or by using the Site or that you transmit to other Members (collectively the "Personal Content"). You understand and agree that Temair may review, edit and remove any Source Data or other Personal Content that in its sole judgment violates these Terms of Use or creates other problems; but you also acknowledge that Temair has no obligation to do so and makes no promise that it will.

Although you retain ownership of your Personal Content, by posting any Source Data or other Personal Content on the Site and electing to make it viewable by Members and others, you grant Temair and its affiliates and Members an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license to copy, perform, display, adapt, incorporate, reformat, translate, excerpt, distribute and in all other respects use such Personal Content (including without limitation on the Site, on other websites, and compiled into collections sold or distributed electronically or in print), and to sublicense these rights to third parties, throughout the world, even after you cancel your membership, except that rights to continue displaying and using your Member Profile terminates when you terminate membership (subject to limited holdover rights – see our Privacy Policy for further details).

If your Personal Content incorporates any writings, images or other content from any academic catalog, library or other third party, you represent that you have express permission to do so or that you have another sound basis for doing so. If you do not you are not permitted to post such content on the Site. You will be responsible for, and indemnify Temair and its other Members from, any damages, losses or third party claims caused by a violation of these Terms of Use or from any problems arising from your Personal Content; you will also reimburse Temair from any reasonable attorneys’ fees or costs we incur in dealing with these issues.

It is Temair’s policy to respond promptly to claims of copyright infringement, and to remove, or disable access to, infringing material. If you believe that any of the Content or materials appearing on this Site contains infringing materials or infringing property, please send a notice to us at the address below.
